The right to swim in Lake Naomi went to the Pennsylvania Supreme Court in 1938, and law students have been reading about it ever since.
The lake is artificial. In 1895 the landowners along Tunkhannock Creek, among them the brothers Frank and Rufus Miller, formed the Pocono Spring Water Ice Company, put a fourteen-foot dam across the creek, and granted the company a 99-year lease for the exclusive use of the water and its privileges.
It was built to cut ice in winter and to carry boats in summer. The railroad had come through two years earlier, which is what made the ice worth cutting.
The argument that followed was about whether rights like that can be split up and sold on. The case is Miller v. Lutheran Conference and Camp Association, and it is still in the property casebooks.

How this one was made
Not wall to wall, so the dam follows the waterline about half an inch out and the flood runs along the shore. Naomi is long and narrow with a shoreline that keeps crimping in and out, and there are islands sitting inside the water that each become a separate shape in the pour. Walnut is the forgiving wood, tighter grained than maple or cherry, so the seal has less working against it. The type is the only other section, off in the bare walnut with a dam of its own.
